geoBIM Desktop – Terms of Use (Beta) ==================================== Version 1.0-beta · Effective: 9 October 2026 1. Provider ----------- geoBIM Desktop ("the Software") is provided by Christof Lorenz, Fischhofer Weg 1, 91154 Roth, Germany, info@geobim.app ("we", "us"). Legal notice: https://desktop.geobim.app/impressum/ 2. Scope -------- These terms apply to the use of the Software in all editions, in particular the free trial edition ("Trial") and beta versions, including updates we provide. By installing or using the Software you accept these terms. If you use the Software on behalf of an organisation, you confirm that you are authorised to accept these terms for it. 3. Beta and Trial ----------------- 3.1 The Software is a beta version. It may contain errors, change without notice, and features may be added, changed or removed. Do not rely on it for safety-relevant or legally binding decisions (for example structural, surveying or approval purposes) without independent verification. 3.2 The Trial is free of charge and intended for evaluation. It contains functional limits (for example on video length and resolution, number of lights, saving placements). You may evaluate the Trial within your company or organisation, including with your own project data. Productive use of the Trial, in particular for paid work for clients, is not permitted. 3.3 We may end the Trial or the beta programme at any time. There is no entitlement to a full version, to support, or to availability of the download. 4. Licence ---------- 4.1 We grant you a non-exclusive, non-transferable, non-sublicensable, revocable right to install and use the Software on devices you control, for the purposes in section 3. 4.2 You may not: - copy, distribute, rent, lend, sell or otherwise make the Software available to third parties, except by pointing them to our official download page; - extract, unpack, decrypt or otherwise access the Software's packaged content (in particular the encrypted content containers, models, materials, textures, sky and weather assets), or use any such content separately from the Software; - extract, export, store or cache map and model data streamed through the Software (in particular terrain, imagery and Google Photorealistic 3D Tiles) beyond the Software's normal temporary cache, or use it outside the Software, unless the data provider's terms expressly allow it; screenshots and videos made with the Software's own functions are allowed with the attributions shown; - reverse engineer, decompile or disassemble the Software, except where mandatory law allows it (in particular § 69e of the German Copyright Act for interoperability); - remove or alter copyright notices, attributions, logos or watermarks (including the watermark in videos and screenshots made with the Trial); - circumvent technical limits, licence checks or encryption; - use the Software in a way that violates applicable law or the rights of third parties. 4.3 Mandatory statutory rights remain unaffected. 5. Third-party components and content ------------------------------------- 5.1 The Software is built with Unreal® Engine (© Epic Games, Inc.). Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States and elsewhere. Epic Games is not a party to these terms and is not liable to you for the Software. Parts of the Software are protected by Epic's intellectual property; the restrictions in section 4.2 apply to them as well. 5.2 The Software uses third-party components and content under their own licences, listed in ThirdPartyNotices.txt that ships with the Software (among others: Cesium for Unreal, Ultra Dynamic Sky, open-source libraries). Their licence terms apply in addition. 5.3 Demo models. The files in the Demo folder are provided under their own licences, named in Demo/CREDITS.txt and shown in the app (for example CC BY 4.0, CC BY-SA 4.0, Bavarian Surveying Administration DGM1 under CC BY 4.0). Section 4.2 does not restrict your rights under those licences; their attribution requirements apply. 6. Online services and accounts ------------------------------- 6.1 Streaming of terrain, imagery and many models requires a Cesium ion account and is subject to Cesium's terms of service (https://cesium.com/legal/). Data you upload to Cesium ion is processed by Cesium, not by us. 6.2 The Software also uses public online services, in particular weather data from Deutscher Wetterdienst via Bright Sky, OpenStreetMap data (© OpenStreetMap contributors, ODbL) and address search. Their availability is not guaranteed. 6.3 Which data the Software and our website process is described in our privacy notice: https://desktop.geobim.app/datenschutz/ (section 10, "Die Desktop-App geoBIM Desktop"). 7. Your data ------------ Models, scenes and settings you create stay on your device or in your own Cesium ion account. We do not receive them. You are responsible for having the rights to the data you load and for backups. 8. Liability ------------ 8.1 The Trial and beta versions are provided free of charge. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we fraudulently concealed a defect. 8.2 Otherwise our liability is excluded, to the extent permitted by law. 8.3 We are not liable for the content, availability or results of third-party services (section 6) or for loss of data that regular backups would have prevented. 9. Term and termination ----------------------- These terms apply for as long as you use the Software. Your right of use ends automatically if you breach section 4; we may also end it with notice by e-mail or by ending the beta programme. On termination you must uninstall the Software and delete copies, except the demo files you may keep under their own licences. 10. Changes ----------- We may change these terms for future versions. Changes are shown on the download page and, where appropriate, in the Software. If you continue to use a new version, the terms in force for that version apply. 11. Final provisions -------------------- 11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection rules of their country of residence remain unaffected. 11.2 If you are a merchant, legal entity under public law or special fund under public law, the place of jurisdiction is Schwabach, Germany. 11.3 Should a provision be invalid, the remaining provisions remain unaffected. 11.4 These terms are published in English only. If a translation is provided, the English version prevails.
